While in the posting, Daniel Lazar, the uploader of Amerika credits himself as the producer of the work. He is not. According to IMDB, Donald Wyre is the Executive Producer; Richard L. O'Connor is the Producer; while John Lugar is the Co-Producer. This is borne out by the closing credits, which also state quite clearly that the copyright is owned by ABC Circle Films, a production subsidiary of ABC Television. The descendant of ABC Circle Films is the ABC Television Group (which currently produces Desperate Housewives and Grey's Anatomy); a wholly owned subsidiary of The Disney-ABC Television Group. Also, a cursory search of the Copyright Office (search term = "Amerika") will get you the copyright registrations for the score (Composed by Basil Poledouris for ABC Music ... Result 12), the screenplay (written by Donald Wyre for ABC Entertainment ... Result 47), each of the 7 parts of the miniseries (ABC Inc., x 7 ... Results 77 through 83) and the Gods only know what. Lastly, the files uploaded are quite obviously digital transfers of very difficult to obtain 1995 Anchor Bay VHS release. To date, there has been no DVD release.

So, yes. This work is very much *not* in the Public Domain and should be removed. Further, I charge that Daniel Lazar, is, at the very least, lying and misrepresenting himself. As much as I'd like to see Amerika here, as the historical curiosity that it is, he is neither the producer nor owner. Not only did he have absolutely nothing (credited) to do with it's production, he has no rights to it, whatsoever.
